MYOB PayDirect Refer a Friend Terms & Conditions

These Terms & Conditions (Terms) govern the MYOB PayDirect Refer a Friend promotion (Promotion).

Some of the words in these Terms have special meanings:

By participating in this Promotion you are bound by these Terms.

1. Privacy a. To participate in this Promotion it will be necessary for you to submit personal information to us about yourself and your friend, such as your names, telephone and email details, to that we can contact your friend in relation to the Promotion and, if applicable, provide you with your Reward. We’ll collect and handle this personal information in the ways described in our Privacy Statement. b. You must only provide personal information to us about your friend where your friend has consented to you providing their personal information to us in connection with the Promotion. c. We will only use the personal information you provide to us about your friend for the purpose of contacting them about the Promotion and their subscription to MYOB PayDirect, and not for any other purposes. Once we have spoken with your friend we may send them additional follow up communications to encourage or remind them to complete the purchase or registration process for MYOB PayDirect. d. If your friend doesn’t end up purchasing MYOB PayDirect we’ll only hold personal information about them for as long as necessary for the administration of the Promotion.

2. How the Promotion works a. To participate: i. visit; ii. follow the on-screen instructions to provide your friend’s name and contact details; and iii. submit the web-form. b. Once we’ve received your friend’s details we’ll then contact your friend to facilitate their MYOB PayDirect and merchant facility application. c. Once your friend’s business has been approved as an MYOB PayDirect merchant, and provided you meet the criteria set out in sections 3 and 4 of these Terms, we’ll issue you with your Reward.

3. Eligibility a. To be eligible for the Promotion you must be: i. a resident of Australia; ii. aged 18 years or over; iii. have obtained your friend’s consent to provide their details, including personal information, to us in connection with the Promotion. You must not provide the contact details of any party who does not consent; iv. have a personal, business or family relationship with your friend. MYOB employees and their immediate family members are not eligible for the Promotion; and v. a registered user of MYOB PayDirect at the time your Reward is verified and approved. b. In addition, your friend must satisfy each of the following criteria: i. be a resident of Australia; ii. be aged 18 years or over; iii. be an owner, director or be able to act on behalf of a business with a valid ABN; iv. have that business register (we’ll phone them to assist with this once you’ve given us their details) and be accepted for the MYOB PayDirect service and merchant facility; v. not cancel their MYOB PayDirect service and merchant facility within 30 days of registration. c. Your friend must be a real person who meets these Terms and who has consented to hearing from us about the Promotion. You cannot refer yourself.

4. Rewards a. If you meet the eligibility criteria and your Reward is verified, then we will send your Reward to you by post to the address you have provided to us. b. We will endeavour to send your Reward to you within 30 days of your friend receiving approval for their MYOB PayDirect merchant facility. c. Rewards are subject to verification. We reserve the right to refuse to verify and grant a Reward if we decide, in our sole discretion, that a referral is fraudulent, suspicious, in violation of these Terms or otherwise an abuse of the Promotion, or will impose potential liability on us. d. Our decisions are final and binding, and no correspondence will be entered into. e. Rewards may not be redeemed for cash and is not transferable. Rewards may not be sold, transferred, auctioned or used for commercial gain. f. If we withdraw the Promotion for any reason, or upon cancellation of your MYOB PayDirect service for any reason, you will forfeit any unredeemed Rewards.

5. Legal a. We reserve the right to amend, suspend or withdraw the Promotion at any time for any reason. b. These Terms may be changed at our sole discretion without notice to you. c. We are not responsible for any Reward that is lost or delayed in transit to the address that we have for you. d. To the fullest extent permitted by law, we shall not be liable to you or any third party for any damages of any kind arising from your participation in the Promotion. Our maximum liability to you and any third party shall be the then-current dollar value of one (1) Reward. e. Coles Myer is not a sponsor of this Promotion. The redemption or use of any Reward is subject to its own terms and conditions and we have no obligations or liability in respect of the same. f. We do not recommend or guarantee the performance of any contractual or other obligations of any third parties mentioned in these Terms (including but not limited to Coles Myer). g. This Promotion is governed by the laws of Victoria.
